Participant Agreement & Release of Liability

I, the undersigned, voluntarily participate in a nature-based gathering organized by Midnight Sun Journeys and its agents, employees, officers, volunteers, and representatives (collectively “Midnight Sun”). In consideration of being allowed to participate, I agree to the following on behalf of myself, my heirs, assigns, and estate:

1. Assumption of Risk

I understand that outdoor activities involve inherent risks that cannot be fully eliminated, including but not limited to: slipping and falling, weather extremes, dehydration, sunburn, wild animals, insect bites, hazardous plants, equipment failure, remote location emergencies, and risks related to my own physical condition. I voluntarily accept all such risks.

2. Release & Indemnification

I release, discharge, and agree to indemnify and hold harmless Midnight Sun from any and all claims, losses, or causes of action arising from my participation, including claims based on negligent acts or omissions of Midnight Sun. I agree to cover any attorney’s fees and costs incurred to enforce this agreement.

3. Insurance & Medical Conditions

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer, or I agree to bear those costs myself. I am willing to assume the risk of any pre-existing medical or physical condition I may have.

4. Governing Law & Severability

Any dispute shall be resolved exclusively in the state of California under California law. If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full effect.

By signing digitally below, I acknowledge that I have read and understood this agreement, had sufficient opportunity to review it, and agree to be bound by its terms. I understand that by signing I may be waiving my right to sue Midnight Sun Journeys for claims covered by this release.
